RESIDENTIAL SITE REQUIREMENTS

CLEARING AND GRADING

Buildings and landscape elements shall be placed on a site so that the maximum number of desirable trees and other natural features are preserved. Materials resulting from clearing and grubbing and all other debris shall be removed from the site promptly. Finish grading methods shall prevent erosion of soil on the site or adjacent property,

TREE PRESERVATION

No trees shall be removed or destroyed on any site prior to approval of plans unless written permission has been obtained from the Architectural Committee. Trees which are to remain shall be protected from damage by barricades or fencing. Stockpiles of earth shall not be permitted within the branch spread. Trees which become damaged must be repaired as soon as final clearing is complete.

LANDSCAPING

Landscaping shall be in accordance with plans approved by the Architectural Committee. All disturbed ground area shall be covered with grass, plants or landscape material. All new trees shall be staked or guyed and guaranteed live by the builder for twelve months.

SCREENING

Screening shall be provided, where required, in accordance with any of the following methods:

  1. A planting screen consisting of a minimum of two staggered rows of evergreen shrubs with a minimum height of six feet installed and spacing that will form an effective visual screen.
  2. An earth bank or berm four feet high with a maximum side slope of 1:3 covered with grass or ground cover suitable to the slope and exposure.
  3. A wall or fence of a material similar to or compatible with that of building may be used for a screen adjacent to the building.
  4. A wall or fence of a material specifically approved by the Architectural Committee may be used for a screen that is not adjacent to the building.
  5. 5. Appropriate changes in ground elevation.

STORAGE

Unless specifically approved by the Architectural Committee, no outside clothes lines, supplies, tractors, boats, trucks, trailers, vans, campers or other materials or equipment except for operating automobiles shall be parked or stored in any area on a site except inside a closed building or behind approved screening so that they are not visible from neighboring properties or public streets. Garbage and refuse containers, transformers, air conditioning and other mechanical equipment, including solar and other alternative energy devices, shall be either concealed within a screen or designed integrally with the building in the most inconspicuous manner possible.

FENCING

Fencing shall be allowed only where a specific purpose is served by such fencing and then only with approval of the Architectural Committee. Any woven metal or chain link fencing shall be suitably screened. No fencing shall be allowed within 50 feet of any lake or pond, within 50 feet‑of the golf course, within 25 feet of any street right‑of‑way or active greenway, or within 10 feet of any inactive greenway. Where allowed, fencing shall be either at a property line or set back 5 or more feet. The height of the fence must be related to the specific purpose(s) of the fence.

DRIVEWAYS

All drives shall be paved with a hard surface material such as asphalt, brick or concrete. Turnouts on curbed streets shall meet Town of Cary standards. Turnouts on uncurbed streets shall meet the‑ Lochmere standards as shown in Appendix C. Driveways shall be set back a minimum of 3 linear feet from side lot line.

SIDEWALKS AND PATHS

Sidewalks shall be constructed of concrete, brick, stone or similar material. Paths (principally within the greenway system) shall be constructed in sidewalk materials or in asphalt or stone based surface as specified by the Architectural Committee for each neighborhood or project.

LANDSCAPE OBSTRUCTIONS

No fence, wall, hedge, shrub planting or grades which may obstruct vehicular sight distance shall be permitted at any driveway turnout or intersection. No fence, wall, hedge, shrubs or trees may be planted on any street right‑of‑way except as may be consistent with a streetscape plan approved by the Architectural Committee.
